By booking or using our services, you agree to comply with these Terms and Conditions. If you do not agree, please refrain from using our services or website.

1. Scope of Services

Zia Luxury Property Observer LLC provides professional snagging and property inspection services for villas, apartments, and commercial buildings. Our inspections are visual and non-invasive and aim to identify construction defects and finishing issues before handover.

All services are:

• Conducted using certified inspection methods and equipment.
• Subject to scheduling and property access availability.
• Delivered with an inspection report summarizing observed findings.

2. Booking and Appointments

• All appointments must be scheduled in advance through phone, email, WhatsApp, or the company website.
• Confirmation will be provided once the booking is accepted.
• Clients are responsible for ensuring property access at the scheduled time.
• Rescheduling is permitted up to 24 hours before the inspection time.
• Cancellations within less than 24 hours may incur a cancellation fee.

3. Payment Terms

• Payment is due upon completion of the inspection, unless otherwise agreed in writing.
• We accept bank transfers, and cash only.
• Reports will only be released once payment is received in full.
• Any discounts or promotional offers must be approved and confirmed in writing before the service date.
• Late payments may result in withholding reports or additional charges.

4. Snagging Reports and Limitations

• Reports reflect the condition of the property at the time of inspection.
• Our inspection is visual and non-destructive; hidden or inaccessible defects are excluded.
• We are not responsible for future damage or issues arising after inspection.
• Reports are intended for client use and should not be altered or shared without prior written consent.

5. Refund and Cancellation Policy

Refunds

• Non-Refundable After Service: Once the inspection is completed and the report delivered, no refunds apply.
• Refund Before Service: Cancellations made at least 24 hours prior to the scheduled time are eligible for a refund, minus a 5% administrative fee.
• Company Cancellation: If Zia Luxury Property Observer LLC cannot complete the inspection due to unforeseen circumstances, the client may request a full refund or reschedule without extra charge.
• Refunds are issued via the original payment method within 2–5 business days.

Cancellations

• 24+ Hours Before Inspection: No charge; reschedule or refund available.
• Less Than 24 Hours: 50% cancellation fee applies.
• No-Show or Access Denied: The full service fee will be forfeited.
• Re-Inspection Policy: One complimentary re-inspection within 60 days of the first report; additional visits charged at 35% of the original fee.

6. Client Responsibilities

By engaging our services, clients agree to:

• Provide accurate property information and ensure access at the agreed time.
• Review the report within 48 hours and raise any clarifications promptly.
• Avoid reproducing, modifying, or distributing reports without authorization.
• Understand that the report is advisory and for informational purposes only.

7. Intellectual Property

• All content, including inspection reports, templates, logos, and website materials, are owned by Zia Luxury Property Observer LLC.
• Unauthorized use, reproduction, or modification of our content is strictly prohibited.

8. Limitation of Liability

Zia Luxury Property Observer LLC shall not be liable for:

• Any losses, damages, or expenses arising from reliance on the inspection report.
• Developer or contractor refusal to act on reported issues.
• Hidden, future, or inaccessible defects not visible during the inspection.
• Indirect or consequential losses.

Our total liability under any circumstances shall not exceed the total amount paid for the inspection service.

9. Modifications

We reserve the right to modify these Terms & Conditions without prior notice. Updated terms will be posted on our website. Continued use of our services implies acceptance of the latest version.

10. Governing Law

These Terms are governed by the laws of the United Arab Emirates, and any disputes shall be handled under the jurisdiction of the courts of Dubai, UAE.
